Submitted to the Govt or not?

Was the 7th CPC Allowance Committee Report submitted to the government as early as February 22?

A high-level committee, under the chairmanship of Finance Secretary Ashok Lavasa was constituted by the Central Government to review the Seventh Pay Commission’s recommendations regarding the allowances being given to the Central Government employees. According to information, the committee had already submitted its report on February 22.

Irrespective of who possesses the report now – the committee or the government – what is more intriguing is the recommendations that it contains.

One could see that the 7th Pay Commission suggested either rationalization or simplification at many places. An example is the Pay Matrix Table, which has now brought the entire Pay Structure of more than 35 lakh employees under one Table. Although there are some anomalies, the system has dramatically simplified the process of annual increment calculation and also pay fixation on Promotion or MACP.

At present 196 different kinds of allowances are being given to the Central Government employees. Some modifications have been recommended in these too as part of the rationalization and simplification drive. The Seventh Pay Commission has recommended the abolition of 52 allowances. And another 36 allowances have been abolished as separate identities, but subsumed either in an existing allowance or in newly proposed allowances.

The Commission said that the entire range of allowances is administered in broadly four ways. Fully DA indexed Allowances, Partially or Semi DA indexed Allowances, No DA indexation Allowances and Percentage based Allowances. House Rent Allowance is being under the category of Percentage based Allowances. The Commission also said that the compensation towards the housing needs of Central Government employees is covered in many ways. The Commission finally suggested that the percentage based allowances by a factor of 0.8, the Commission recommends that HRA should be rationalized to 24 percent, 16 percent and 8 percent of the Basic Pay for Class X, Y and Z cities respectively.

The big irritation, or rather disappointment to the Central Government employees was the recommendation to reduce the percentage of House Rent Allowance (HRA).

All trade unions have expressed their harsh opposition to the proposed cuts in HRA. The Central Government employees’ Federations also expressed their disappointment through various protest. Finally the Central Government accepted to constitute a high level committee to examine the recommendations of 7th Pay Commission regarding Allowances.

Now, sources claim that the committee has already submitted its report to the government.

The government can announce its final decision on the recommendations of the committee any day. But, many believe that there could be a delay in the announcements due to the state elections that are being held in various parts of the country and the election commission’s guidelines that are being enforced now.

Unconfirmed reports say that the committee has recommended the percentage rates of HRA as per 6th CPC and changes in the method of calculating Transport Allowances also.

The biggest mystery however is – will these recommendations be given retrospective effect and will arrears be given?

Three dates are currently being suggested – January 1, 2016; August 1, 2016; and April 1, 2017.

Only the Central Government has all the answers right now.

விடுப்பு மறுப்பு /தாமதம் குறித்து நடந்த விவாதத்தில் நமது தரப்பு விரிவான விளக்கத்தை கொடுத்தது .யாரையும் குற்ற படுத்தவோ /வருத்தப்படவோ கொடுக்கப்பட்ட கோரிக்கைகள் அல்ல ..பொதுக்குழுவில் நமது உறுப்பினர்கள்  வெளிபடுத்திய ஆதங்கங்களை தான் நாம் சேர்த்திருந்தோம் .பதிலுக்கு கோட்ட நிர்வாகமும் எத்தனை அலுவலகங்களுக்கு விடுப்பு வழங்கியிருக்கிறோம் என்ற பட்டியலை தந்தது .நாம் எத்தனை அலுவலகங்களுக்கு வழங்கப்படவில்லை என்பதனை விளக்கினோம் .நமது நோக்கம் விடுப்பு கேட்டு காத்திருக்கும் ஊழியர்கள் தேவையில்லாத டென்ஷனில் சிக்கி தவிக்கக்கூடாது --சாங்க்ஷன் செய்யப்பட்ட விடுப்பு விவரங்களை முன் கூட்டியே தெரிவித்தால் எல்லாரும் ஒரு நிம்மதியோடு பணியாற்றுவார்கள் என்பதனை எடுத்து கூறினோம் .மானுர் ,ICPETTAI போன்ற A கிளாஸ் அலுவலகங்கள் தனி ஒருவரால் நிரவகிக்கப்படுவதை யும் --டெபுடேஷன் பொறுத்தவரை பர்கிட்மான க ரத்தில் இருந்து பத்மனேரி என்பதனை இனியாவது தவிர்க்கப்படவேண்டும் என்றும்  திசையன்விளை அலுவலகத்தில் ரயில் டிக்கெட் முன்பதிவு இயங்குவதால் முழுநேர ஊழியர் விசாரணை போன்ற விஷயங்களில் தொடர்ந்து பணியாற்ற வேண்டியதை மனதில கொண்டு அங்கு குறைந்தபட்சம் 4 எழுத்தர்கள் என்ற எண்ணிக்கை என்பது தொடர வேண்டும் என்றும் --LRPA பட்டியல் விரைவில் வெளியிட வேண்டும் என்றும் அப்படி LRPA ஆக அடையாளம்காட்டப்படுவோர் HO /LSG அலுவலகங்களில் டெபுடேஷன் PURPOSE ஆக இணைக்கப்படவேண்டும் என்றும் வலியுறுத்தப்பட்டது .

நமது பொதுக்குழுவிற்கு பின்பு சில விஷயங்களில் கோட்டநிர்வாகம் துரும்பை தூணாக்கி பார்க்கிறது .உதாரணமாக தவறுதலாக அலுவலக ஈமெயில் இருந்து கோட்ட செயலருக்கு அனுப்பப்பட்ட ஈமெயில் குறித்து விளக்கம் கேட்டிருந்ததை நாம் கவலையோடு விளக்கினோம் .கோட்ட நிர்வாகத்தோடு ஒரு இணக்கமான உறவுகளை மேற்கொண்டுவரும் நமக்கு இதுபோன்ற செயல்கள் நம்மை சிந்திக்க வைக்கிறது .ஆகவே தோழர்கள் இனி தங்கள் சொந்த  ஈமெயில்யில் இருந்து எந்த தொடர்ப்பு கொள்ளவும் என்று  கேட்டு கொள்ளபடுகிறார்கள்

Consequent to the issue of implementation Cell, Department of Expenditure OM No.1-6/2016-IC dated 7th September,2016, a number of representations have been received from AAOs under this organization through their respective Min./Deptt. regarding fixation of pay by bunching of stages in comparison with Sh.Babu Balram Jee, AAO, CPWD, IBBZ-I, Malda M/o UD in terms of the OM ibid. With a view to facilitate the accounting organisations under CGA, the service Book of Sh. Babu Balram Jee, AAO duly audited has been obtained from the M/o UD. The Pay details of Sh.Babu Balram Jee, AAO are as follows:

1	Basic pay (Pay in the pay Band plus Grade Pay) in the pre revised structure on 1.1.2016:	Rs. 14900/- (Rs.10100 + Rs.4800)
2	Revised Basic Pay on 1.1.2016 in terms of Revised Pay Rules, 2016:	Rs. 47600/- (1st Cell of 8th Level)

All respective accounting units of Ministries/Departments concerned may extend the benefit of bunching to eligible persons in adherence to the Department of Expenditure OM No.1-6/2016-IC dated 7th September, 2016. Sub: Resolutions passed in the General Body meeting of our union held on 17,02.2017

 The General Body meeting of our union was held on 17.02.2017 at Palayamkottai HO under the president ship of Sri,K.G.Gurusamy in the evening

        Many resolutions were passed in the above meeting regarding staff grievances, The issues recently developed and the staff members of our union agitating for settlement of issues are brought to your notice for early intervention

1.Frenetic attitude of ASP HQS to our staff members

    Recently  the SPM  Tirunelveli Town contacted the ASP HOS requested to repair the one existing printer The ASP asked the SPM who were the officials handled the printer wrongly instead of ordering issue of repairing  the printer The way which the ASP HOS replied is condoned, If he followed such action  no grievance will be settled regarding computers .The General Body request the SSPO’S to issue suitable advice to the ASP HOS to avoid such kind of unnecessary talks .

2. Refusal of leave to single handed SPM and other SPM

    The single handed SPM’s apply for leave in advance but the relief orders are issued in the last minute on the reason that the leave letters are not received at the DO.It is not in one or two cases but in 98% cases the DO replies that  the leave letters of  SPM’s are not received .It is not known where the leave letters of the SPM’s  have gone. While issuing the deputation orders the concerned SPM is not informed about the deputation order. Only the orders are sent to the office deputing the PA’s.These are highly  wrong attitude of ASP’s HQ and the staff working at DO.The deputation orders have to be issued well in advance immediately on receipt of leave letters from the SPM’s, so that the SPM’s be in peace regarding grant of leave.The General Body contemned such actions to follow a regular procedure of leave to single handed SPM’s. The officers in DO threatening in over phone when the SPM not able to carryout the deputation order due to on strong grounds. In future such practice should  be avoided and correspondence may through email.  

3. Reqularization of deputation orders

   For leave arrangement of SPM’s deputation of PA’s are ordered from the office locating at very far distance instead of deputing from the nearest office  for example PA from Burkitmanagaram SO to Padmaneri SO.Resolution is passed to carry out such deputations from the nearest Sub Office.

4.To maintain reasonable staff position at Tisaiyanvillai SO

   At Tisaiyanvillai SO  3PA’s are working instead of 6PA’S one PA is exclusively for working for booking Railway Ticket.Hence shortage of PA below the strength of 4 PA could not be managed.one PA from other office to be deputed to Tisaiyanvillai so when the shortage of PA less than 4PA. This resolution is  passed  in General Body.

5.Allotment of MTS for CPC work at T irunelveli HO.

  

     One MTS was previously encaged in CPC  work at Tirunelveli HO.But it has been stopped. The CPC work could not be managed without MTS.Resolution is passed MTS to allot for this work at least for half day in the forenoon daily.

6.MMS issues

      a.  The confirmation orders Sri.S.Balasubramanian Driver has not been issued so far,since the SSP intimated the case has been refered to Manager MMS Madurai in his letter dtd DMMS/ PF/ SB Dated   11-08-015.The case is pending for more than one year.The confirmation orders may kindly be issued on getting immediately. It is brought to the notice the confirmation order SSPO’S Salem division is issued confirmation to the MMS driver working in his division. The copy of the order is enclosed for reference. Resolution is passed to issue confirmation order immediately without waiting for clarification.

  b. One Driver MMS is vacant for a long period.It is difficult now to run the mail vans with the existing

drivers causing heavy work load to the drivers.The vacant post may be filled up by engaging out sider drivers.

7. Issue of LRPA  list for the year 2017

   The LRPA for the list 2016 has been issued on 04-02-2016. The  LRPA list for the year 2017 has not yet been issued by DO.The LRPA is working in regular post he/she may be actually ordered to work as LRPA in HO/ bigger SO’s for deputation purpose etc.

8.concluding view of our members of our union

      Abnormal delay is noticed while ordering in many cases like leave,passing of bills and other welfare activities.The staff request for early settlement of issues  without delay by the SSPOs.

    I request the SSPO’s to kindly intervene in this matter and settle the all issues  immediately.

NJCA chief Shiv Gopal Mishra confirmed that the allowances report would be submitted on Wednesday.

New Delhi, Feb 21: Committee on allowances, headed by Finance Secretary Ashok Lavasa, will submit its report tomorrow, claims National Joint Council of Action (NJCA) convenor Shiv Gopal Mishra. Central government employees were expecting the report to be tabled by Monday. However, the committee delayed the submission due to unspecified reasons. The report would pave the way for the implementation of hiked allowances as per the revised 7th Pay Commission recommendations.

“Government has made no announcement yet. But the report by Committee on allowances would be tabled tomorrow,” Shiv Gopal Mishra said, while speaking exclusively to India.com. On being asked whether the government would make an announcement in relation to the arrears on allowances, he replied, “Let us see what comes out of the report. We are expecting the hike in allowances, as per our demands. We have to wait and see whether the government makes an announcement on arrears as well.”

The committee on allowances was formed in July 2016, after central government employees raised several anomalies related to the 7th Pay Commission report submitted by Justice (retd) AK Mathur. The 7CPC report had recommended the abolition of 51 existing allowances, and subsumption of 37 others of the total 191 allowances.

The major point of grievance was the reduction in Housing Rent Allowance (HRA) offered to central government employees. As per the 6th Pay Commission report, the HRAs provided were 30 per cent, 20 per cent, 10 per cent for employees living in ‘X’, ‘Y’, ‘Z’ category towns/cities. However, the 7th Pay Commission report decreased the allowances to 24, 16 and 8 per cent of the basic pay.

Reduction in HRA has irked a major section of central government employees, who reside in rented accommodations. A section of the aggrieved employees have blamed the top bureaucracy for the delay in HRA hike. “Naturally, the common central government employees are more affected by the delay in allowance hike. The top bureacrats don’t take higher allowances, therefore, they are not interested in the hike,” Mishra said.

Apart from the hike in allowances, central government employees have also demanded Centre to provide arrears on the allowances. Since the date of implementation of 7th Pay Commission was fixed as January 1, 2016, employees have demanded the release of arrears on allowances as well.

Although the government provided arrears on basic pay while hiking the salaries on July 1, indications have been made that no arrears would be released on allowances. NJCA has confirmed that the employee unions would launch protest across the nation if the allowances are hiked, without the arrears. “Arrears are unlikely, but protests would be launched if they fail to release (the arrears),” Mishra said.

The date of allowances hike is reported to be April 1. NJCA claims, through its sources, that the government would be implementing the allowance hike from April 1. “It is most likely that the government announces the hike by April 1,” Mishra confirmed.

Subject: Setting up of Anomaly Committee to settle the anomalies arising out of the implementation of the Seventh Pay Commission’s recommendations.

The undersigned is directed to refer to DoPT’s OM of even number dated 16/8/2016 and to incorporate the following modification in the definition of anomaly:

“Where the Official Side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.”

2. With the incorporation of the above para in the O.M., the definition of anomaly will read as follows:

(1) Definition of Anomaly

Anomaly will include the following cases;

a) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Sixth Central Pay Commission itself without the Commission assigning any reason; 

b) Where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Pay Band under the pre-revised structure as notified vide CCS(RP Rules 2016, is less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules; 

c) Where the Official side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.

3. The rest of the content of the O.M. dated 16.08.2016 shall remain unchanged.

v Against the betrayal of Central Government employees and pensioners by Group of Ministers of NDA Government.

v  Demanding increase in minimum pay and fitment formula.

Dear comrades

We know that all of you are in the midst of hectic preparation and campaign for making the 16^thMarch Strike action a great success.  As has been explained in the article, which we have placed on our website, the NDA Government, led by BJP has exhibited the worst anti-employee attitude in the post independent  era of our country.  This Government has treated its own employees as its worst enemy. The decision taken by the Union Cabinet on 29^th June, 2016 rejecting even the recommendations made by the high level committee chaired by the Cabinet Secretary was unprecedented. Even the setting up of various committees was nothing but an eye wash. Nothing will come out of that.  Even the NPS Committee on which the young comrades had pinned some hope of at least  getting a minimum guaranteed pension will produce nothing.  The discussions at the JCM fora has been converted into mostly monologues i.e. the official side simply listening and not reacting.  The Government, it appears, has made the Pension department to reject the one and only recommendation of the 7^th CPC which was considered to be positive i.e. Option No.1 for pensioners on the specious ground that the same is not feasible to be implemented. The allowances committee has dilly dallied its deliberation and would now submit its report after the extended period of 6 months expires on 22.02.2017. Even if they make any positive recommendation, which is seldom expected, the NDA Government would not act upon it.  They have very successfully postponed the payment of the revised allowanced for 15 months. 

                In the face of such terrible onslaught, betrayal and chicanery, which no Government in the past has every indulged in,  it is surprising that some of our friends who has a predominant role in the movement of the Central Government employees has unfortunately chosen to wait and watch.  It appears that they have chosen to wait endlessly hurting the cause of the workers. 

                We have no hesitation to affirmatively state the obvious that we have chosen the right path, the path of struggles, which can only the choice of the working class against tyrannical attitude of the employer, howsoever, powerful they may be. We must realize that those who are  in the saddle of power today are not permanently posted there. We were witness to the abysmal downfall of persons who were arrogant personified.  It appears that the reasonableness, righteousness and patience we had exhibited have been taken as signs of cowardice. The undeniable fact is that those who fight, only can win. We, therefore, appeal to you to carry on with conviction and courage.

                Eight months will be over on 6^th March, 2017, when the Group of Ministers held out the assurance of revisiting the minimum wage and multiplication factor.  It is now crystal clear that that was an act of chicanery.  No committee was set up  and no discussions were held to seriously consider the issue.  We, therefore, appeal to all of you to ensure that the day, i.e. 6^thMarch, 2017 is observed as a day of betrayal and all our members are requested to wear a Black badge with the following words inscribed on it in bold letters and conduct demonstrations in front of all Central Government offices.

6^TH March 2017 must be yet another occasion to mobilize our members to ensure their participation in the 16^th March, 2017 strike action and ultimately win all the demands in the charter.
